Vázquez – Rebollar v West Broadway Properties, LLC

Plaintiff was a 62 year old foreign national who slipped and fell on a piece of ice on a ramp while exiting the defendant’s restaurant in Manhattan late at night after dinner and drinks. Plaintiff reinjured a prosthetic hip that required an open reduction internal fixation procedure with implantation of plates and screws to repair the hip prosthesis. With a summary judgment motion pending to dismiss the case, a settlement was reached in the amount of $450,000.00.

Berdejo / Pérez / Mendez v Margaret Treacy

This driver and 2 passengers were involved in an automobile accident where the defendant ran a red light and t-boned the plaintiffs van. As a result of this heavy impact in which all 3 plaintiffs were seat belted, the van rolled over and landed on its roof. Berdejo injured her lower back and shoulder and underwent arthroscopic surgery to repair her shoulder. Perez injured his neck and shoulder and also required an arthroscopic surgery to fix the tear in his shoulder. Mended sustained soft tissue injuries to her neck and back which required physical therapy. The case was settled early in the discovery phase of litigation for the total sum of $350,000.00.    

O’Dea v. Gordon

This case concerned a 47 year old postal worker who while on the job in a postal truck was rear ended by the defendant’s vehicle. He sustained neck and back injuries as well as a chest contusion and abdominal injuries. He had multiple surgeries including a drainage of the abscess in his abdomen, multiple injections in his neck and back and a subsequent open heart surgery due to a condition called atrial fibrillation which it was claimed was caused by the accident. The case settled before trial for $997,500.00 out of a possible $1,000,000.00. 

Wellington v. I Move Green LLC

A 49 year old passenger in a motor vehicle which was sideswiped and then rear ended by a box truck sustained injuries to his neck and back and ultimately had arthroscopic surgeries to his knee and shoulder to repair tears in both in both of those areas. Much later in time, the client underwent a laminectomy and fusion in his lower back at the L3-L5 levels. The case settled before trial for $769,909.69 which was the remainder of the funds available on the applicable insurance policy.

Dennington v. Port Authority of New York & New Jersey

This matter involved a 28 year old laborer who was working on the “bathtubs” of the WTC disaster site when he tripped and fell on a piece of wood protruding from a beveled crane mat. As a result of the fall, the client sustained knee and ankle injuries which required several arthroscopic procedures to remedy. There was a substantial lost earning claim and worker’s compensation lien applicable to the case. The case settled after a mediation at JAMS for $900,000.00 plus a $436,000.00 Medicare Set Aside (“MSA”).  

Mejia v. Oven Artisans, Inc.

A 31 year old severely intoxicated man attempted to cross Bruckner Boulevard in the Bronx at night and was struck by this baked goods delivery truck. Mr. Mejia sustained multiple fractures to his arms and legs that required multiple surgical procedures to correct. He also sustained a head injury that rendered him unconscious at the scene and unable to recall any of the events surrounding the accident. An accident reconstruction expert had to be retained in order to explain the manner in which the accident occurred. The case settled before trial for $550,000.00.

Hernandez v. 2883 Third Ave Realty

A 49 year old woman while attempting to cross the street in the Bronx stepped up onto a curb and fell over a cracked portion of the sidewalk fracturing her left ankle in  3 places in what is called a trimalleolar left ankle fracture. She required an open reduction surgical procedure that included the implantation of a 6 hole tubular plate and multiple screws to fixate the fractured bones of the ankle. Case settled before trial for $425,000.00. 

King v. Con Edison, Inc.

This unfortunate 39 year old client while attempting to flag a cab in the Bronx stepped onto a manhole cover which shifted and caused him to fall directly into the manhole. As a result of the accident, the client sustained hip, neck, back, knee and shoulder injuries. He received over 20 injections to his neck and back during the several year course of treatment and sustained a left shoulder labral tear which required arthroscopic surgery to correct. Case settled before trial for $340,000.00.

McCarthy v. Art Van Lines

This New York County case revolved around a 40 year old truck driver who was involved in a rear end collision with another truck on the Cross Bronx Expressway. He sustained an L5-S1 disc herniation that required surgery to correct with a subsequent surgery resulting in a discectomy, fusion and hardware in his lower back. There was a substantial lost earning component to the claim as well. Case settled before trial for $1,500,000.00.
 

Arias v. 123 Vermilyea Corp.

This case involved a 43 year old woman who fell down a flight of stairs due to a defective handrail. She sustained lower back injuries which required two surgeries to correct including a laminectomy with fusion and subsequent removal of several screws in her back. The client developed a MRSA infection during the second surgery that necessitated prophylactic antibiotic treatment and a PICC line for almost 6 months. Case settled before trial for $785,000.00 out of a possible $1,000,000.00.
