Vázquez – Rebollar v West Broadway Properties, LLC

Plaintiff was a 62 year old foreign national who slipped and fell on a piece of ice on a ramp while exiting the defendant’s restaurant in Manhattan late at night after dinner and drinks. Plaintiff reinjured a prosthetic hip that required an open reduction internal fixation procedure with implantation of plates and screws to repair the hip prosthesis. With a summary judgment motion pending to dismiss the case, a settlement was reached in the amount of $450,000.00.

Berdejo / Pérez / Mendez v Margaret Treacy

This driver and 2 passengers were involved in an automobile accident where the defendant ran a red light and t-boned the plaintiffs van. As a result of this heavy impact in which all 3 plaintiffs were seat belted, the van rolled over and landed on its roof. Berdejo injured her lower back and shoulder and underwent arthroscopic surgery to repair her shoulder. Perez injured his neck and shoulder and also required an arthroscopic surgery to fix the tear in his shoulder. Mended sustained soft tissue injuries to her neck and back which required physical therapy. The case was settled early in the discovery phase of litigation for the total sum of $350,000.00.

Bell v. F.A.

This 35 year old man slipped and fell on a recently mopped floor in a restaurant where he worked as a security guard in the Bronx. He sustained left shoulder rotator cuff and labral tears which required arthroscopic surgery to repair, as well as lower back injuries that necessitated over 5 years of physical therapy treatment with approximately 10 injections. He remained out of work since the date of the accident to present, however at trial the jury was told that he had his own video production company where he was working for approximately 2-3 years. The Bronx County jury returned a verdict in plaintiff’s favor in the amount of $1,416,000.00.

Kushay v. LIRR

This 54 year old woman slipped and fell on an accumulation of ice on the westbound LIRR platform in the great Neck train station. She sustained a trimalleolar right ankle fracture which required open reduction with the implantation of 2 plates and approximately 12 screws to fix. She underwent several months of physical therapy treatment and lost approximately 6 months from work. The Queens County jury returned a verdict in favor of the plaintiff and against the LIRR in the liability phase of this bifurcated trial. The case settled before the trial on damages began for $354,000.00.

Felix v. Oasis Auto Body Shop

A 48 year old man had been drinking for over 8 hours and was highly intoxicated when he called a cab to take him home from downtown Manhattan. Along the way the cab driver decided to take the car to an auto body shop to have his oil changed. The client passed out in the back seat and was left in the vehicle when it was put on a car lift and raised approximately 6 feet off the ground. The client then awoke and not realizing he was 6 feet in the air, attempted to exit the vehicle and fell to the ground sustaining a trimalleolar right ankle fracture that required surgery with the implantation of a plate, approximately 10 screws and k-wires to reattach the shattered bones of the ankle. After trial, the Bronx County jury returned a verdict in favor of the plaintiff in the amount of $395,000.00, even though they attributed much of the fault of the accident to him. The case against the auto body shop settled before the start of trial for $200,000.00.

O’Dea v. Gordon

This case concerned a 47 year old postal worker who while on the job in a postal truck was rear ended by the defendant’s vehicle. He sustained neck and back injuries as well as a chest contusion and abdominal injuries. He had multiple surgeries including a drainage of the abscess in his abdomen, multiple injections in his neck and back and a subsequent open heart surgery due to a condition called atrial fibrillation which it was claimed was caused by the accident. The case settled before trial for $997,500.00 out of a possible $1,000,000.00.

Wellington v. I Move Green LLC

A 49 year old passenger in a motor vehicle which was sideswiped and then rear ended by a box truck sustained injuries to his neck and back and ultimately had arthroscopic surgeries to his knee and shoulder to repair tears in both in both of those areas. Much later in time, the client underwent a laminectomy and fusion in his lower back at the L3-L5 levels. The case settled before trial for $769,909.69 which was the remainder of the funds available on the applicable insurance policy.

Dennington v. Port Authority of New York & New Jersey

This matter involved a 28 year old laborer who was working on the “bathtubs” of the WTC disaster site when he tripped and fell on a piece of wood protruding from a beveled crane mat. As a result of the fall, the client sustained knee and ankle injuries which required several arthroscopic procedures to remedy. There was a substantial lost earning claim and worker’s compensation lien applicable to the case. The case settled after a mediation at JAMS for $900,000.00 plus a $436,000.00 Medicare Set Aside (“MSA”).

Mejia v. Oven Artisans, Inc.

A 31 year old severely intoxicated man attempted to cross Bruckner Boulevard in the Bronx at night and was struck by this baked goods delivery truck. Mr. Mejia sustained multiple fractures to his arms and legs that required multiple surgical procedures to correct. He also sustained a head injury that rendered him unconscious at the scene and unable to recall any of the events surrounding the accident. An accident reconstruction expert had to be retained in order to explain the manner in which the accident occurred. The case settled before trial for $550,000.00.

Hernandez v. 2883 Third Ave Realty

A 49 year old woman while attempting to cross the street in the Bronx stepped up onto a curb and fell over a cracked portion of the sidewalk fracturing her left ankle in 3 places in what is called a trimalleolar left ankle fracture. She required an open reduction surgical procedure that included the implantation of a 6 hole tubular plate and multiple screws to fixate the fractured bones of the ankle. Case settled before trial for $425,000.00.

King v. Con Edison, Inc.

This unfortunate 39 year old client while attempting to flag a cab in the Bronx stepped onto a manhole cover which shifted and caused him to fall directly into the manhole. As a result of the accident, the client sustained hip, neck, back, knee and shoulder injuries. He received over 20 injections to his neck and back during the several year course of treatment and sustained a left shoulder labral tear which required arthroscopic surgery to correct. Case settled before trial for $340,000.00.

McCarthy v. Art Van Lines

This New York County case revolved around a 40 year old truck driver who was involved in a rear end collision with another truck on the Cross Bronx Expressway. He sustained an L5-S1 disc herniation that required surgery to correct with a subsequent surgery resulting in a discectomy, fusion and hardware in his lower back. There was a substantial lost earning component to the claim as well. Case settled before trial for $1,500,000.00.

Arias v. 123 Vermilyea Corp.

This case involved a 43 year old woman who fell down a flight of stairs due to a defective handrail. She sustained lower back injuries which required two surgeries to correct including a laminectomy with fusion and subsequent removal of several screws in her back. The client developed a MRSA infection during the second surgery that necessitated prophylactic antibiotic treatment and a PICC line for almost 6 months. Case settled before trial for $785,000.00 out of a possible $1,000,000.00.

Luna v. Delrosario: Supreme Court, Bronx County

$400,000.00 for a man involved in a motor vehicle accident when he was rear ended by another vehicle and although sustaining no damage to his vehicle injured his neck requiring a surgery in which a cervical disc was removed and two (2) vertebrae fused.

Zeas v. City of New York:

$450,000.00 for a construction worker who was struck by a metal plate as it was being lowered to the ground to cover a hole in the roadway and sustained a left foot fracture requiring surgery and insertion of plate and screws

Seidt v. Edwards:

$585,000.00 for a man who tripped and fell while exiting a private home due to inoperable exterior lights sustaining a fractured right femur requiring surgery with implantation of hardware and residuals

Otero v. Dorian: Supreme Court, Bronx County

$600,000.00 for a man on a bicycle struck by a motor vehicle while he was attempting to ride in a park sustaining two (2) fractured vertebrae in the neck area which required surgery and fusion of the vertebrae

Pacheco v. HAR Construction Company:

$650,000.00 for a construction worker who fell from a scaffold when wood planking he was walking on shifted, sustaining a broken nose, fractured skull and shoulder injury requiring surgery

Elkin v. Blue Sea Construction Company:

$650,000.00 for a construction worker who slipped and fell down snow covered exterior stairs that did not contain a handrail and sustained a shoulder injury which required two (2) separate surgeries.

Budhu v. Capital One Bank: Supreme Court, Queens County

$725,000.00 for a woman who tripped and fell on a cracked portion of the sidewalk sustaining a fracture of the right femur requiring implantation of hardware and resulting in a slightly shortened leg

Barker v. AMB Property:

$825,000.00 for a man who slipped and fell while working on a loading dock and sustained injuries to the neck which required a cervical discectomy and fusion with insertion of hardware at multiple levels of the neck

Morales v. Central Parking:

Plaintiff, a 40 year old woman slipped and fell on an ice patch while attempting to exit her car in defendant’s parking lot. As a result of the fall, plaintiff sustained a left trimalleolar ankle fracture which required surgery with the implantation of hardware to repair. Soon afterwards the plaintiff developed a neurological condition cause complex regional pain syndrome which was treated with a course of pain management medications. The case settled before trial for the sum of $1,300,000.00.

Dula v. City of New York:

$1,600,000.00 for a man injured in an accident with a New York City Department of Sanitation truck sustaining lower back injuries and injections which resulted in an abscess and necrotizing fasciitis of the back.

Belton v. Greene, Supreme Court, Bronx County:

$200,000.00 awarded by the jury in this one (1) day trial where a bicyclist was struck by a motor vehicle driver’s mirror and sustained a fractured rib and knee injuries that required surgery

Burdier v. City of New York: Supreme Court, Queens County:

$200,000.00 for a man injured playing basketball in a New York City park sustaining an ankle fracture requiring surgery and insertion of hardware

Moscovici v. G.A. Balzofiore, Supreme Court, Kings County:

$295,000.00 for a man involved in a motor vehicle accident sustaining shoulder injuries requiring arthroscopic surgery and physical therapy to repair

Resto v. Gueye, Supreme Court, New York County:

$375,000.00 for a female pedestrian struck by a motor vehicle sustaining knee injuries which required arthroscopic surgical intervention and physical therapy

Gregory v. Miller’s Tool Rental, Supreme Court, Kings County:

$1,500,000.00 for a man who fell from a ladder sustaining foot and ankle injuries requiring three (3) separate surgeries and a cane to ambulate.

Simon v. New Morgan Cafe, Supreme Court, Queens County

$1,350,000.00 for a woman who slipped and fell sustaining shoulder injuries that resulted in two (2) arthroscopic surgeries and “frozen” shoulder syndrome

Sepulveda v. Santos Bakery, Supreme Court, Bronx County

Plaintiff, was a 32 year old woman who was rear ended by a bakery truck in the Bronx. As a result of the impact, plaintiff hit her head on the rear head rest causing serious head injuries. Plaintiff was later diagnosed with a seizure disorder as a result of the accident. After a full trial on liability and damages, a Bronx County jury awarded the plaintiff the sum of $1,175,000.00.
